A storm is brewing in the Delhi and District Cricket Association (DDCA) ahead of the Annual General Meeting, expected to be scheduled shortly. After Apex Council’s decision to put secretary Vinod Tihara under provisional suspension, 65 members in a joint application as called for a resolution to remove Rajat Sharma from the president’s office.
A group of 65 DDCA members have got together to press two key resolutions in the forthcoming AGM. In two separate letters, addressed to the DDCA secretary and other Apex Council members, the applicants have challenged the amendments in the Articles of Association of the company (DDCA) and placed on record an intent to remove veteran journalist Rajat Sharma from the office of the DDCA president.
Tihara, however, cannot act upon two letters as he has been put under provision suspension, pending an inquiry by the DDCA ombudsman. The action was initiated as he had challenged Sharma’s nomination for the BCCI AGM and electoral process as the DDCA representative “in violation of” the Delhi State cricket body’s constitution”.
It will be interesting to see how the other Apex Council members react to the notices as a majority in the DDCA Apex Council has been party to the amendments in the Articles of Association in their capacity as the DDCA Directors. DDCA president, too, enjoys an absolute majority support in the council.
The applications, if considered, will make it mandatory to include both the “items” in the upcoming AGM.
DDCA is registered as a non-profit company under the Companies Act.
The members in the letters have stated that the amendments as per the Companies Act could not have been enforced without a nod from the general body.
The signatories to the notices have also submitted sworn-in affidavits with the letters to the DDCA secretary and the Apex Council members. “The move (to submit affidavits) was necessitated as an earlier formal request by over 500 members to call the general body meeting was dismissed by the people vicious interests on the pretext that all the signatures were not authentic,” said Manish Sharma, who has signed the application to move the resolution for removing the DDCA president.
